We respect the privacy of the Users and we hereby undertake to protect the Users’ personal data under all generally applicable laws, including in particular those set out in the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals concerning the processing of personal data and on the free movement of such data and repealing directive 95/46/EC (general data protection regulation; hereinafter referred to as “GDPR”).

The Users are hereby requested to read the Policy carefully, as it contains important information about how and why we collect and process the Users’ personal data, as well as about the Users’ rights in relation to such processing.

What information / data regarding the User do we collect?

Concerning the information contained below, “Personal Data” shall mean the information that directly or indirectly identifies the User.

We may collect, use, store or transfer some or all of the following types of personal data regarding the User:

  • Behavioural information about the User’s visit to the Website. When the User interacts with our Website, we automatically collect technical data about the User’s equipment, activities and browsing patterns. We collect this Personal Data utilizing cookies.   • The User’s contact details, including first and last name, company name, telephone number and email address, in the case of submission of an enquiry via the contact forms on our Website.

We do not process any Special Category Personal Data – the so-called sensitive data (such as the details of the race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health information or genetic and biometric data), or any information relating to criminal convictions or offences.

We may also collect and process the User’s Personal Data from other sources, such as publicly available databases, social media, third parties or persons who recommend the User or the User’s company.

For what purpose and on what basis do we process the Users’ Personal Data?

The data protection legislation requires that we indicate the purpose and legal basis for the processing of the Users’ personal data. We process the personal data of the Website Users for the following purposes and on the following basis:

  • For the purposes of our legitimate interests, based on Article 6(1)(f) of the GDPR

Our legitimate interest is to carry out our business / economic activity, which is to offer and provide high quality products and services. Accordingly, we process the Personal Data we collect in order to inform the Users of our Website about our company and products, as well as to establish and maintain contact with potential and existing customers and business partners. We use the Users’ Personal Data only to the extent necessary for these purposes and always with respect for their rights and freedoms.

We may also process the Users’ Personal Data visiting our account / fan page, within the YouTube channel or Facebook / Linkedin social network in relation to our legitimate interest consisting in the need to properly manage the EMBS channel / account, including ensuring communication with the User, responding to the User’s questions / comments.

We consider and balance all potential impacts for the User (both positive and negative) and the User’s rights before we process the User’s Personal Data under our legitimate interests. We do not use the User’s Personal Data for activities where our interests override the impact on the User (unless we have the User’s express and voluntary consent to do so, or it is required or permitted by law).

  • To comply with our contractual or legal obligations, or to take pre-contractual action, based on Article 6(1)(b) of the GDPR or Article 6(1)(c) of the GDPR

We also process the User’s Personal Data in order to perform the contract concluded with the User or to comply with our legal obligations (in particular, under tax law and accounting regulations). This may also include responding to enquiries sent via a contact form, where the processing of the data is necessary to take action at the User’s request before entering into such a contract.

Who do we share the Users’ Personal Data with?

We may share the User’s Personal Data with the following parties if it is necessary to fulfil the purposes for which we collected it:

  • Affiliates within the EMBS Group;
  • External third parties, including law enforcement or other authorities, if required to comply with a legal or regulatory obligation.

We require all third parties to respect the security of the User’s Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use the User’s Personal Data for their own purposes and we only allow them to process the User’s Personal Data for specific purposes and in accordance with our instructions.

International data transfer

The User’s Personal Data may be transferred to and stored at destinations outside the European Economic Area (EEA) (for example, in the USA). It may also be processed by staff based outside the EEA who work for one of our service providers. We will take reasonable steps to ensure that the User’s personal data is secure and treated in accordance with this Policy and applicable data protection laws.

Where appropriate, we provide relevant safeguards, such as:

  • EU-US Data Privacy Framework: The mechanism, approved on 10 July 2023, replaces the previous EU-US Privacy Shield regime and introduces new binding safeguards to limit access to data by the US intelligence services and provide redress for EU citizens. How do we secure the Users’ Personal Data?

We have implemented appropriate security measures to prevent the User’s Personal Data from being accidentally lost, used or accessed in an unauthorised manner, altered or disclosed. We restrict access to the User’s Personal Data to the persons who need to access it for business reasons. As part of our security measures, we may occasionally require the User to provide proof of identity before disclosing Personal Data to the User.

We regularly monitor our systems for possible vulnerabilities and attacks and conduct tests to identify ways to further strengthen security. All Personal Data transmitted through our Website is encrypted using SSL/TLS technology to ensure its protection during transmission. We will notify the User and any relevant regulatory authorities of a suspected data security breach if we are legally obliged to do so.

Information regarding the Website and social media

When visiting our Website (https://embatterysystems.pl) and our social media profiles (Facebook, LinkedIn, YouTube), we collect and process Personal Data following our Policy. This data includes behavioural information about the User’s visit, IP addresses and contact details provided in forms. We use cookies to collect technical information and analyse website traffic. How long do we keep the Users’ Personal Data?

We will only retain the User’s Personal Data for as long as necessary to fulfil the purposes for which we collected it, including, to comply with any legal, accounting or reporting requirements.

In the context of processing the Personal Data of the Website Users, the retention periods are adjusted for the following purposes:

  • Informing about the company and products: data will be stored until the purpose is fulfilled or the user objects.
  • Establishing and maintaining contact: contact data will be stored for the duration of the business relationship and for the period of the statute of limitations for claims.
  • Responding to enquiries: data from the contact form will be stored for the time necessary to respond and for the period of the statute of limitations for claims arising from the communication.

After the expiry of the retention period, the Personal Data will be securely deleted or anonymised, unless further retention is required by law.

Rights of the User

Under the GDPR, the User has several important rights that can be exercised (as a rule) free of charge. The User has the right to:

  • request provision of details or copy of the Personal Data we store regarding the User;
  • request the User’s Personal Data to be corrected if it is inaccurate and completed if it is incomplete;
  • object to or restrict the processing of the User’s Personal Data in certain circumstances;
  • request erasure of the User’s Personal Data in certain circumstances; and
  • in certain circumstances request the transfer of the User’s Personal Data to a third party (another controller).
